Terms of Use

These terms are an agreement between you and Animesh Kumar, trading as FirmGenie (sole proprietorship, GSTIN 19DDNPK8068R1Z9, Third Floor, B9/6, 301, AC-119/1, BlueOffice Workspace, Prafulla Kanan (East), Kestopur, Kolkata, North 24 Parganas, West Bengal 700101). "We" means FirmGenie; "you" means the person or business using FirmGenie. By running an audit, creating, publishing or paying for a website, you agree to them.

1. What FirmGenie does

• A free check (audit) of how your business shows up online, compared with nearby businesses.
• AI-written websites for your business, hosted by us on a FirmGenie address or your own domain, with enquiry, booking and order forms and automatic emails to your customers.
• Paid extras shown on the Pricing page, such as domains, Google profile care, a website chatbot, content calendars and business apps.

2. Your account

• Give true details and keep your email and phone up to date. Keep the private links and sign-in codes we send you to yourself; anyone who has them can change your website.
• You must be 18 or older and able to make a contract under Indian law.
• Only create a website for a business you own, or one that has authorised you (clearly allowed you to act for it). When you publish, you confirm this with a tick box, and we keep a record of that confirmation with the date and a hashed version of your internet address.

3. Acceptable use

You must not use FirmGenie to publish or send anything that:

• pretends to be another business, brand, person or government body, or uses names, logos, photos or text you do not own or have permission to use;
• is illegal in India, including counterfeit goods, unlicensed medicines, gambling, or obscene or sexual content;
• is phishing, malware or a scam, or asks visitors for passwords, card numbers, UPI PINs or OTPs;
• contains false or misleading claims, fake reviews, or prices and offers you do not honour;
• harms children, or is hateful, harassing or threatening;
• shares other people's personal data without a lawful reason.

Websites whose name matches a well-known brand, or whose Google listing is very large, are checked by our team before they go live (usually within 24 hours), and we may ask you for proof.

4. Reports and takedowns

• Anyone can report a website made with FirmGenie using the "Report this site" link in its footer, or by emailing animesh@firmgenie.in with the website address and what is wrong.
• We acknowledge a report within 24 hours and decide within 15 days. Clearly unlawful content, such as impersonation, phishing or scams, is taken down as soon as we see it. Intimate images shared without consent are removed within 24 hours of a complaint, and content named in a court order or a lawful government notice within 36 hours.
• When we take a website down we tell its owner why, unless the law or safety stops us. Owners can reply with proof (for example that they own the brand) and ask us to restore it.
• We may pause or remove a website that breaks these terms, and refuse service to anyone who misuses FirmGenie.

5. Your content

• You own the words, photos, logos and data you give us, and the content of your website.
• You give us a non-exclusive, royalty-free licence to store, copy, adapt and show that content only to build, host, improve and show your website and to provide the services you asked for. The licence ends when your website is deleted, except for backups kept for a short time and records the law requires.
• Our software, templates, designs and the FirmGenie name remain ours.

6. AI-generated content

• Our AI writes text only from what you and your Google listing tell us, but AI can make mistakes. It can get a price, timing or claim wrong.
• You must read and check your website before publishing and after every change, and correct anything that is not true. You are responsible for what your website says to your customers.
• Chatbot answers on your website come only from your own details, but they can still be wrong. Check the chat log in your workspace now and then.

7. Payments

• Prices, what is included and how renewal works are shown before you pay. Refunds and cancellation follow our Refunds and cancellation policy.

8. Availability

• We aim to keep websites online all the time, but we do not promise any particular uptime. Hosting, email, maps, AI and payments depend on other companies (such as Cloudflare, Google, Resend and Cashfree), and planned maintenance or their outages can interrupt the service.
• FirmGenie is provided "as is" and "as available". To the extent the law allows, we give no promise that it will be error-free or meet every need, or that it will bring you a particular number of customers or sales.

9. Limit of our liability

• Our total liability to you for any claim about FirmGenie is limited to the fees you paid us in the 12 months before the claim.
• We are not liable for indirect losses such as lost profits, lost business or lost data, or for losses caused by content you gave us or by services outside our control.
• Nothing in these terms limits liability that cannot be limited under Indian law, including under the Consumer Protection Act, 2019.

10. Your responsibility to us (indemnity)

If someone makes a claim against us because of content you put on your website, your breach of these terms or your breach of the law (for example a trademark claim or a claim by one of your customers), you will cover our reasonable costs and losses from that claim.

11. Suspension and ending

• You can stop using FirmGenie at any time and ask us to delete your website and data.
• We may suspend or end your access if you break these terms, do not pay (see the grace period in our refund policy), or if the law requires it. Where we can, we warn you first and give you time to fix the problem.
• After a website is deleted, you can ask us within 30 days for a copy of your content.

12. Data Processing Addendum (for your website's visitors)

This part applies whenever your website collects personal data from your visitors or customers: enquiries, bookings, orders, chatbot messages, customer sign-ins and emails to them.

• Roles. For that data you are the Data Fiduciary under the DPDP Act and FirmGenie is your Data Processor. We process it only to run your website's features, on your instructions (your settings in FirmGenie are your instructions), and not for our own purposes.
• What you do. You decide which forms and features are on, give your visitors a privacy notice (we create one for you at /privacy on your website, naming your business), answer their requests to see, correct or delete their data, and have a lawful reason for any message you send them.
• What we do. We keep the data confidential and limit access to people who need it; protect it with reasonable security (HTTPS, encrypted secrets, access controls); use only the sub-processors listed in our Privacy policy (Cloudflare, Google, Resend, Cashfree, GitHub), under contracts that protect the data; help you answer your visitors' rights requests; tell you without undue delay, and within 48 hours where we can, if a breach affects your visitors' data, so you can inform them and the Data Protection Board; and delete or return the data when you ask or when your website is deleted, except what the law makes us keep.
• Transfers. Sub-processors may process data outside India, as allowed by the DPDP Act.
• Payments on your website. When your customers pay online, the money goes to your own Cashfree account; FirmGenie never holds it.

13. Governing law and disputes

• These terms are governed by the laws of India. The courts having jurisdiction over FirmGenie's registered office have exclusive jurisdiction, subject to any right you have as a consumer to go to a consumer commission.
• Please email us first. Most problems are solved quickly that way.

14. Changes

We may update these terms. If a change matters, we email account holders before it applies. Continuing to use FirmGenie after that means you accept the new terms.
